Majmu' al-FatawaIbn Taimiya

He—may Allah have mercy on him—was asked:

A man freed a slave while he was in need, burdened with debts, and without means. May he sell the slave and use the proceeds to repay his debt?

He replied:

If, when he freed him, he was solvent and owed no debt, or owed a debt that he could repay from property other than the slave, then the slave has become free, and the emancipation cannot be revoked. If, however, his debts exhausted his assets when he freed him, the scholars differ concerning the validity of the emancipation. And Allah knows best.

He was asked:

A man brought a claim against his debtor before a judge. The debtor acknowledged the debt, his ability to repay it, and his solvency. The judge then imprisoned him and barred him from disposing of his property. The imprisoned debtor subsequently wished to establish his insolvency before another judge. Is he entitled to do so?

He replied:

His claim of insolvency, after acknowledging his ability to repay and after being barred from disposing of his property, is not accepted unless he explains what caused him to lose his solvency, and that cause is ordinarily plausible—for example, a fire in the house containing his belongings, or something similar. Nor is he entitled to seek a final judgment on this matter.
