Majmu' al-FatawaIbn Taimiya

He was asked:

A debt was claimed against a man’s son, who then went into hiding, so payment was sought from his father. What is the ruling?

He replied:

If the father has not guaranteed his son’s debt and holds none of his son’s money, he may not be pursued for what his son owes. However, if the father can help the creditor have his son brought forward by disclosing his whereabouts or similar means, he must do so. Otherwise, he bears no responsibility. It is unlawful to demand anything from him on his son’s account, and the ruler must protect him from wrongful treatment.

He was asked:

A scribe worked for an emir who borrowed money from someone. The emir forcibly compelled the scribe to guarantee the debt personally, and he did so, although he was under his father’s guardianship with his legal capacity restricted. Is he bound by the guarantee he gave or not?

He replied:

If it is established by an admission and evidence, or by his handwriting, that he gave the guarantee, he is bound by it, for the Prophet, may Allah bless him and grant him peace, ruled:

“The guarantor is liable.”

If, however, it is established that he was under legal restrictions and was not entitled to manage his own affairs independently, his guarantee is invalid;
