He—may Allah have mercy on him—was asked:
A man built a house with an upper and a lower storey, directing the drainage from the upper onto the lower. He then sold the house to two people in two separate transactions, without informing the buyer of the lower storey that it was subject to a drainage right. The buyer has suffered harm as a result. What is the ruling?
He replied:
The sale applies to the property as it actually stands. However, if the buyer did not know that someone else had a right over his roof, he may rescind the sale or receive compensation for the reduction in value.
He was also asked:
A man sold a green crop before it had matured. Is this permissible?
He replied:
Selling a crop on condition that it be left standing is impermissible by agreement of the scholars. Purchasing it on condition that it be cut is permissible by agreement. Selling it without either stipulation is impermissible according to the vast majority of scholars, for “the Prophet, may Allah bless him and grant him peace, prohibited selling grain until it hardens and grapes until they turn black.”
