He—may Allah have mercy on him—also said:

The report that the Prophet, peace and blessings be upon him, “ordered them to cut open the wine containers and break the wine jars” supports one of the two reported opinions permitting their destruction when putting a stop to wrongdoing, and establishes that a container takes the same ruling as its contents.

Similarly, it is established that ‘Umar ibn al-Khattāb and ‘Alī ibn Abī Tālib ordered the burning of premises where wine was sold. Ahmad also expressly endorsed this. The same applies to destroying instruments used to produce prohibited musical compositions, namely musical instruments. Such penalties involving property are established by the Sunnah and the practice of the caliphs. Whoever claims that they have been abrogated has no evidence for that claim.

Some have argued on the basis of the following report:

“When the Prophet, peace and blessings be upon him, learned that they had cooked donkey meat, he told them: ‘Pour it out and break the pots.’ They asked: ‘Could we not pour it out and wash the pots?’ He replied: ‘Do so.’”

They argue: “Perhaps, had they asked his permission regarding the wine vessels, he would have said the same.”
