the option of rescinding or approving the sale. If the property can be divided without detriment, he may compel his co-owner to divide it. If it cannot be divided without detriment, he may demand that the whole property be sold so that they can divide the proceeds. If the witness knows that the seller is acting unjustly and witnesses the sale to assist him in doing so, he has assisted in sin and transgression. Assisting in unlawful contracts by witnessing them is impermissible.
Indeed, it is authentically reported that the Prophet (may Allah bless him and grant him peace) said:
“Allah has cursed the recipient of usury, its payer, its two witnesses, and its scribe.”
He also said:
“I do not bear witness to injustice.”
Anyone who persists in such conduct compromises his moral integrity. Allah knows best.
He was asked—may Allah have mercy on him:
Is it permissible to sell grapes to someone who will press them into wine if their owner is compelled by necessity to do so?
He replied:
It is not permissible to sell grapes to someone who will press them into wine. Indeed, the Messenger of Allah (may Allah bless him and grant him peace) cursed anyone who presses grapes for someone who makes wine from them. What, then, of the person who sells them to him, thereby providing even greater assistance? There is no necessity to do this: if he can neither sell them fresh nor dry them into raisins, he can make them into vinegar, grape syrup, or something similar.
