Majmu' al-FatawaIbn Taimiya

So ʿĀʾisha did so. Then the Messenger of Allah, may Allah bless him and grant him peace, stood before the people, praised Allah and extolled Him, then said:

‘To proceed: Why do some men stipulate conditions that are not in the Book of Allah? Any condition that is not in the Book of Allah is invalid, even if there are a hundred such conditions. Allah’s ruling is more binding, and Allah’s stipulation is firmer. The right of patronage belongs only to the one who emancipates.’”

In a narration recorded by al-Bukhārī:

“‘Buy her and emancipate her, and let them stipulate whatever they wish.’ So she bought her and emancipated her, and her owners stipulated that the right of patronage over her should belong to them. The Prophet, may Allah bless him and grant him peace, said, ‘The right of patronage belongs to the one who emancipates, even if they stipulate a hundred conditions.’”

Another wording reads:

“Allah’s stipulation is more binding and firmer.”

In the two Sahīh collections, ʿAbd Allāh ibn ʿUmar reported:

“ʿĀʾisha, the Mother of the Believers, wished to buy a slave woman in order to emancipate her. Her owners said, ‘Shall we sell her to you on condition that the right of patronage over her belongs to us?’ She mentioned this to the Messenger of Allah, may Allah bless him and grant him peace, who said, ‘Do not let that prevent you, for the right of patronage belongs only to the one who emancipates.’”

In Muslim’s collection, Abū Hurayrah, may Allah be pleased with him, said:

“ʿĀʾisha wished to buy a slave woman and emancipate her, but her owners refused unless the right of patronage belonged to them. She mentioned this to the Messenger of Allah, may Allah bless him and grant him peace, who said, ‘Do not let that prevent you, for the right of patronage belongs only to the one who emancipates.’”

They draw two arguments from this hadith. The first is his statement:

“Any condition that is not in the Book of Allah is invalid.”

Thus, every condition that is neither in the Quran, nor in the hadith, nor in
