—may Allah bless him and grant him peace—with the Muslims, and the intercession of the Muslims with the Messenger of Allah.’”

He then rose and addressed the people, saying:

“I have returned these people’s captives to them. Whoever wishes may willingly consent to this; whoever wishes otherwise, we shall give him ten young she-camels for each person, from the first spoils Allah grants us.”

This was compensation for emancipation, like the payment under a contract of emancipation, consisting of camels owed without further specification, payable after a variable, undefined period.

Al-Bukhārī narrated from Ibn ʿUmar, in the account of Khaybar:

“The Prophet, may Allah bless him and grant him peace, fought them until he drove them into their fortress and gained control of the land, crops, and date palms. They then concluded a settlement with him whereby they would leave, taking whatever their riding camels could carry, while the gold, silver, and arms—that is, weapons—would belong to the Messenger of Allah, may Allah bless him and grant him peace. They were to depart, and he stipulated that they must conceal or hide nothing. If they did, they would have neither protection nor covenant.”

This was a settlement in return for property that was identifiable but not fully known.

Ibn ʿAbbās said:

“The Messenger of Allah, may Allah bless him and grant him peace, concluded a settlement with the people of Najrān requiring them to deliver two thousand sets of clothing to the Muslims: half in Safar and the remainder in Rajab. In the event of a hostile plot or raid in Yemen, they were also to lend thirty coats of mail, thirty horses, thirty camels, and thirty of each kind of weapon for use in military expeditions. The Muslims would be liable for these until they returned them.”

Narrated by Abū Dāwūd. Thus, this was a settlement in return for unspecified garments of a known
