or entered ihram for Hajj after that?
If he entered ihram before circumambulating the House and traversing between the two hills, then he was unquestionably performing qirān. If, however, he entered ihram for Hajj only after circumambulating the House and traversing between the two hills, without having left his ihram, then he is called a performer of tamattu‘ because he performed ‘umrah before entering ihram for Hajj. He is also called a performer of qirān because he entered ihram for Hajj before leaving his ihram for ‘umrah. Accordingly, some of our fellow scholars call him “a performer of tamattu‘,” others call him “a performer of qirān,” and others apply both names to him, which is the most correct approach. This concerns tamattu‘ in its restricted sense; in its broader sense, it unquestionably includes him.
Nevertheless, the correct view is what Ahmad affirmed decisively: that the Prophet, may Allah bless him and grant him peace, entered ihram for Hajj before circumambulating the House, because he said:
“Here I am, answering Your call for ‘umrah and Hajj.”
Even if it were from the moment one enters ihram for ‘umrah, together with His words—glory be to Him:
“Then fast three days during Hajj.”
For ‘umrah has become part of Hajj, as the Prophet, may Allah bless him and grant him peace, stated.
Since the ‘umrah of someone performing tamattu‘ is part of his Hajj, the sacrificial animal brought along must not be slaughtered until he completes his prescribed rites, as Allah Most High says:
“Then let them complete their prescribed rites and fulfil their vows.”
This refers to the sacrificial animal brought along, for it is a vowed offering. Thus, if it becomes incapacitated before reaching its appointed place, it must be slaughtered. For its slaughter is to take place only when it reaches its appointed place, and it reaches that place only when its owner reaches the point at which he may leave ihram, since it follows his status. Its owner reaches that point only on the Day of Sacrifice, because before then he cannot leave ihram unconditionally: he is required to perform Hajj. This differs from someone who performs ‘umrah on its own, for he leaves ihram unconditionally.
