He was asked:
“May a woman who has already performed Hajj perform Hajj on behalf of a deceased woman for payment?”
He replied:
“There is agreement that she may perform Hajj on behalf of the deceased with funds received for acting as a proxy. As for doing so under a contract of hire, scholars hold two views, both of which are reported from Ahmad. The first permits it; this is the view of al-Shāfiʿī. The second does not permit it; this is the position of Abū Hanīfa.
“If this woman’s intention in performing Hajj on behalf of the deceased is to perform Hajj or to benefit the deceased, she will receive reward and recompense for that. But if her sole intention is to receive payment, she will have no share in the Hereafter.”
He was asked about someone who performed Hajj on behalf of another in order to repay his debt.
