He was asked:

If a man kisses or embraces his wife and emits pre-ejaculatory fluid, does this invalidate his fast or not?

He replied:

According to most scholars, this invalidates his fast.

He was asked:

About someone who breaks his fast in Ramadan, etc.

He replied:

If he breaks his fast in Ramadan, declaring it lawful despite knowing that it is prohibited, he must be put to death. If he acts in sinful disobedience, he is to be punished for breaking his fast in Ramadan as the ruler sees fit, and the prescribed punishment for unlawful sexual intercourse is to be inflicted on him. If he is ignorant, he is to be informed of this, and the prescribed punishment for unlawful sexual intercourse is to be inflicted on him. The matter is referred to the ruler’s considered judgment. And Allah knows best.

وَسُئِلَ: عَمَّا إذَا قَبَّلَ زَوْجَتَهُ أَوْ ضَمَّهَا فَأَمْذَى. هَلْ يُفْسِدُ ذَلِكَ صَوْمَهُ؟ أَمْ لَا؟ فَأَجَابَ: يَفْسُدُ الصَّوْمُ بِذَلِكَ عِنْدَ أَكْثَرِ الْعُلَمَاءِ. وَسُئِلَ: عَمَّنْ أَفْطَرَ فِي رَمَضَانَ إلَخْ فَأَجَابَ: إذَا أَفْطَرَ فِي رَمَضَانَ مُسْتَحِلًّا لِذَلِكَ وَهُوَ عَالِمٌ بِتَحْرِيمِهِ اسْتِحْلَالًا لَهُ وَجَبَ قَتْلُهُ وَإِنْ كَانَ فَاسِقًا عُوقِبَ عَنْ فِطْرِهِ فِي رَمَضَانَ بِحَسَبِ مَا يَرَاهُ الْإِمَامُ وَأُخِذَ مِنْهُ حَدُّ الزِّنَا وَإِنْ كَانَ جَاهِلًا عُرِّفَ بِذَلِكَ وَأُخِذَ مِنْهُ حَدُّ الزِّنَا وَيُرْجَعُ فِي ذَلِكَ إلَى اجْتِهَادِ الْإِمَامِ وَاَللَّهُ أَعْلَمُ.
