The questioner’s concern is with a woman experiencing non-menstrual bleeding. We have explained that the correct view is that under no circumstances is she required both to fast and to make up that fast, as some followers of al-Shāfiʿī, Ahmad and others require in certain cases. Nor is she required to perform the ritual bath for every prayer, by agreement of the four imams and others. Allah knows best.
He was asked:
Regarding a woman with postnatal bleeding who has not performed the ritual bath: is intercourse with her permissible before she bathes?
He answered:
Intercourse with a menstruating woman or a woman with postnatal bleeding is not permissible until she has performed the ritual bath. If she cannot find water, or fears harm from using it because of illness or severe cold, she should perform dry ablution, after which intercourse with her is permissible. This is the position of the great majority of the imams, including Mālik, al-Shāfiʿī and Ahmad.
The Quran indicates this in the words of the Most High:
“Do not approach them until they are pure,”
meaning until the bleeding stops;
“Then, when they have purified themselves,”
meaning when they have bathed with water. Likewise, He says:
“If you are in a state of major ritual impurity, purify yourselves.”
Reports supporting this have been transmitted from leading Companions, including ʿUmar, ʿUthmān, ʿAlī, Ibn Masʿūd, Abū Mūsā and others. They held that the husband had the greater claim to her so long as she had not bathed after her third menstrual period.
As for Abū Hanīfah, his position is that if the bleeding stops after ten days or more, and a prayer time has elapsed for her or she has performed the ritual bath, he may have intercourse with her; otherwise, he may not. Allah knows best.
