his affairs, until this verse was revealed: “Forbidden to you are your mothers”—to the end of the verse. Allah, Mighty and Majestic, thereby abrogated the former ruling, and temporary marriage became forbidden. This is confirmed by the Quranic words, “except from their wives or those whom their right hands possess.” Any sexual relation apart from these is forbidden.”
I say: Mūsā ibn Ubayda is weak, as stated in al-Taqrīb. Al-Dhahabī said in al-Duafā: “They declared him weak, and Ahmad said: ‘It is not lawful to narrate from him.’”
Through him, al-Tirmidhī (2/187) also recorded it without commenting upon it! Al-Hāzimī likewise recorded it in al-Itibār (p. 140) and said:
“This chain is sound were it not for Mūsā ibn Ubayda, and he is al-Tirmidhī.”
The Hafiz said in Fath al-Bārī (9/140):
“Its chain is weak, and it is anomalous, contradicting what was stated earlier concerning the reason for its permissibility”—meaning being away from home while travelling.
I say: Among the reports that further weaken the preceding narrations from Ibn Abbās is what Ubayd Allah related:
“Ibn Abbās used to issue fatwas permitting temporary marriage, and the scholars criticized him for it. Yet Ibn Abbās refused to back down from that position, until one of the poets began to say:
My friend, would you take up Ibn Abbās’s ruling?
Would you have a fair, buxom woman,
Your lodging until the people depart?”
Al-Bayhaqī (7/205) recorded it, and its chain is sound.
