the hadith of Abū Hurayra, who reported that the Prophet (peace and blessings be upon him) said: “Whoever casts off obedience, separates from the community, and then dies, dies a death of the Age of Ignorance. Whoever fights beneath a banner of blind partisanship—becoming angry for a faction, calling to a faction, or supporting a faction—and is killed, dies a death of the Age of Ignorance.…” Another narration states: “He is not of my Ummah.”
305 — (Wāthila ibn al-Asqaʿ said: I asked, “O Messenger of Allah, what is tribal partisanship?” He replied: “It is to assist your people in wrongdoing.” Abū Dāwūd.) p. 237
Weak. Abū Dāwūd (5119) narrated it by way of Salama ibn Bishr al-Dimashqī, from the daughter of Wāthila ibn al-Asqaʿ.
This chain is weak. Wāthila’s daughter is unknown, although some named her (Fusayla). Salama ibn Bishr al-Dimashqī is also of unknown status. No one besides Ibn Hibbān declared him trustworthy, while al-Dhahabī accused him of concealing an intermediary in this hadith—meaning that the ʿAbbād ibn Kathīr mentioned below stood between him and Fusayla. He was corroborated by Sadaqa ibn Yazīd, who said: “Wāthila’s daughter narrated it to me.” Abū Ishāq al-Harbī narrated it in Gharīb al-Hadīth (59/1) by way of al-Walīd ibn Muslim, from him. This Sadaqa, al-Khurasānī al-Shāmī, has some weakness.
He was also corroborated by ʿAbbād ibn Kathīr al-Shāmī, who narrated from a woman among them called (Fusayla). She said: “I heard my father say…” and then related the hadith. Ibn Mājah (3949), al-Dūlābī in al-Kunā (48/1), and al-ʿUqaylī in al-Duʿafāʾ (274) narrated it. Al-ʿUqaylī said:
“Regarding ʿAbbād, al-Bukhārī said: ‘There are reservations about him.’ This man narrates from Wāthila ibn al-Asqaʿ and others through a chain stronger than this one.”
Regarding this ʿAbbād, al-Nasāʾī said in al-Duʿafāʾ (p. 21):
“He is not trustworthy.”
