Next comes innovation (bidʿah): it is either (1) an innovation that entails disbelief (2) or one that merely renders a person sinful (3).
As for the first type, the majority (5) do not accept the transmitter who holds it (4).
Regarding the second, the narrator is accepted (6) so long as he is not an active propagandist—this is the sounder position—unless he relates (7) something that reinforces his innovation. In that case the report is rejected, according to the preferred view, a ruling explicitly stated by al-Jawzajani (8), the teacher of al-Nasaʾi.
(1) MS B adds the words “an takuna.”
(2) MSS H and Z read “bi-kufrin” (“for disbelief”).
(3) MS H adds “aw bi-fisqin” (“or for flagrant sin”).
(4) MS B has “la yaqbalahu” (“it is not accepted”) in place of “la yaqbalu sahibaha” (“its transmitter is not accepted”).
(5) MS Z reads “al-majhul,” a scribal slip; MS B also inserts: “wa-qila: yuqbalu” (“and it is said: it is accepted”).
(6) MS H includes the word “ma.”
(7) MSS B and W read “yarwi” (“he narrates”).
(8) MS D vocalises the nisba as “al-Jawzajani” with a fatha on the first jim; the reading adopted here follows MS H. Ibn Ruslan states in his commentary on Sunan Abi Dawud (12/372): “Al-Juzjani is pronounced with a damma on the first jim, a fatha on both the zay and the lightened jim, followed by a nun; it is an attribution to a town in Khurasan near Balkh called Juzjan.” See also al-Qari, Sharh Sharh al-Nukhba, p. 531.
