and this is the sounder of al-Shafi‘i’s two views, owing to his statement, peace and blessings be upon him: “If it eats, then do not eat, for it caught it for itself.”
Some scholars, however, permitted eating it. This was narrated from Ibn Umar, Salman al-Farisi, and Sa‘d ibn Abi Waqqas, and it was also the view of Malik, based on what was narrated from Abu Tha‘labah al-Khushani, who said: The Messenger of Allah, peace and blessings be upon him, said: “When you send your dog and mention the name of Allah Most High, then eat, even if it eats from it.” (1)
As for an untrained one among the ⦗102a⦘ hunting animals, if it catches game, or a trained one that goes out without being sent by its owner, catches and kills it, then it is not lawful unless its owner reaches it while it is still alive and slaughters it; in that case, it is lawful.
Abd al-Wahid ibn Ahmad al-Mulayhi informed us; Ahmad ibn Abd Allah al-Nu‘aymi informed us; Muhammad ibn Yusuf informed us; Muhammad ibn Isma‘il informed us; Abd Allah ibn Yazid informed us; Haywah informed me; Rabi‘ah ibn Yazid al-Dimashqi informed me, from Abu Idris, from Abu Tha‘labah al-Khushani, who said: I said, “O Prophet of Allah, we live in a land inhabited by the People of the Book. May we eat from their vessels? And we live in a land of game, where I hunt with my bow, with my untrained dog, and with my trained dog. What is lawful for me?” He said: “As for what you mentioned regarding the vessels of the People of the Book: if you find other vessels, then do not eat from them; but if you do not find any, wash them and eat from them. Whatever you hunt with your bow, having mentioned the name of Allah over it, then eat. Whatever you hunt with your trained dog, having mentioned the name of Allah over it, then eat. And whatever you hunt with your untrained dog, if you reach it in time to slaughter it properly, then eat.” (2)
His saying, exalted is He: “And mention the name of Allah over it, and fear Allah. Indeed, Allah is swift in reckoning.” This shows that mentioning the name of Allah over an animal to be slaughtered is a condition at the time it is slaughtered; and in hunting, at the time one dispatches the hunting animal or shoots the arrow.
Abu al-Hasan Abd al-Rahman ibn Muhammad al-Dawudi informed us; Abu al-Hasan Ali ibn Muhammad ibn Ibrahim ibn al-Hasan ibn Alawiyah al-Jawhari informed us, who said: Abu al-Abbas Muhammad ibn Ahmad ibn al-Athram al-Muqri’ of Basra narrated to us; Umar ibn Shaybah informed us; Ibn Abi Adi informed us, from Sa‘id, from Qatadah, from Anas, who said: “The Messenger of Allah, peace and blessings be upon him, sacrificed two horned, salt-and-pepper rams. He slaughtered them with his own hand, pronounced the name of Allah, and declared His greatness. He said: I saw him placing his foot upon their sides and slaughtering them with his own hand
