Tafsir al-BaghawiAl-Baghawi

Al-Zuhri said: This was because of his saying, “They do not ask me for any terms by which they honor the sacred ordinances of Allah except that I grant them to them.” So he wrote: “These are the terms agreed upon by Muhammad ibn Abdullah and Suhayl ibn Amr: they have agreed to suspend war between the people for ten years, during which the people shall live in safety and refrain from fighting one another.”

The Prophet, peace and blessings be upon him, said to him, “On condition that you allow us access to the House, so that we may circumambulate it.” Suhayl said, “By Allah, the Arabs must not say that we were forced into it; rather, that shall be next year.” So he wrote it.

Suhayl then said, “And on condition that no man from among us comes to you—even if he is upon your religion—except that you return him to us.” The Muslims said, “Glory be to Allah! How can he be returned to the polytheists when he has come as a Muslim?”

Abu Ishaq narrated from al-Bara the account of the treaty, in which they said, “Had we known that you were the Messenger of Allah, we would not have prevented you from anything. But you are Muhammad ibn Abdullah.” He said, “I am the Messenger of Allah, and I am Muhammad ibn Abdullah.” Then he said to Ali, may Allah be pleased with him, “Erase ‘Messenger of Allah.’” Ali said, “No, by Allah, I shall never erase it.” He said, “Show it to me.” So he showed it to him, and the Prophet, peace and blessings be upon him, erased it with his own hand.

In his narration, it states: The Messenger of Allah, peace and blessings be upon him, took the document, though he did not know how to write, and wrote: “These are the terms agreed upon by Muhammad ibn Abdullah.”

Al-Bara said: He made peace on three conditions: that whoever came to him from the polytheists would be returned to them, while whoever came to them from the Muslims would not be returned; that he would enter it the following year and remain there for three days; and that he would enter only with weapons in their sheaths—swords, bows, and the like.

Thabit narrated from Anas that Quraysh made peace 132/b with the Prophet, peace and blessings be upon him, and stipulated: “Whoever among you comes to us, we shall not return him to you; and whoever among us comes to you, you shall return him to us.” They said, “O Messenger of Allah, should we write this?” He said, “Yes. Whoever leaves us for them, Allah has sent him far away; and whoever comes to us from among them, Allah will grant him relief and a way out.”

Returning to al-Zuhri’s narration, he said: While they were thus engaged, Abu Jandal ibn Suhayl ibn Amr came dragging his chains. He had escaped and made his way out from the lower part of Makkah, until he threw himself into the midst of the Muslims.

Suhayl said, “O Muhammad, this is the first person concerning whom I require you to fulfill our agreement: you must return him to me.” The Prophet said, “We have not yet finalized the document.” He said, “Then, by Allah, I shall never make peace with you on any terms.” The Prophet, peace and blessings be upon him, said, “Then grant him protection for my sake.” He said, “I will not grant him protection for your sake.” He said, “Yes, do so.” He replied, “I will not.”

Then Suhayl began dragging him away to return him to Quraysh. Abu Jandal said, “O assembly of Muslims! Am I to be returned to the polytheists when I have come as a Muslim? Do you not see what I have suffered?” He had been severely tortured for the sake of Allah.

The hadith further states that the Messenger of Allah, peace and blessings be upon him, said, “O Abu Jandal, seek your reward from Allah. Indeed, Allah will grant you and the oppressed believers with you relief and a way out. We have concluded a binding agreement and a truce with these people, and we do not act treacherously.”

Umar then sprang up and walked alongside Abu Jandal, saying, “Be patient, for they are only polytheists, and the blood of any one of them is no more than the blood of a dog.” He held the hilt of the sword close to him. Umar said, “I hoped that he would take the sword and strike his father with it, but the man could not bring himself to strike his father.”
