Whoever misses Hajj—and Hajj is missed when one fails to stand at ‘Arafah before dawn breaks on the Day of Sacrifice—then exits the state of ihram by performing the rites of ‘Umrah. He must make it up the following year and offer an expiatory sacrifice, which is subject to the same order and prescribed scale as the sacrificial offering for tamattu‘ and qiran.
Abu al-Hasan al-Sarakhsi informed us; Zahir ibn Ahmad informed us; Abu Ishaq al-Hashimi informed us; Abu Mus‘ab informed us, from Malik, from Nafi‘, from Sulayman ibn Yasar, that Hannad ibn al-Aswad came on the Day of Sacrifice while ‘Umar ibn al-Khattab was slaughtering his sacrificial animal. He said, “Commander of the Believers, we miscalculated the date; we had thought that today was the Day of ‘Arafah.” ‘Umar said to him, “Go to Mecca. You and those with you should circumambulate the House, go between al-Safa and al-Marwah, and slaughter a sacrificial animal if you have one with you. Then shave your heads or shorten your hair, and return. When the following year comes, perform Hajj and offer a sacrificial animal. Whoever cannot find one must fast three days during Hajj and seven when you return.” (1)
“And fear Allah”: by fulfilling His commands. “And know that Allah is severe in punishment”: for committing what He has prohibited.
