and deterrence (tarhīb)(1). This is an error committed by its perpetrator(2), born of ignorance, for both encouragement and deterrence form part of the Sharia’s legal rulings.

The scholars are unanimously agreed that deliberately lying about the Prophet ﷺ is one of the major sins(3). Abu Muḥammad al-Juwaynī(4) went even further and declared anyone who intentionally fabricates a lie(5) against the Prophet ﷺ to be an unbeliever(6).

They are likewise unanimous that it is prohibited to transmit a fabricated report unless one clearly states that it is fabricated, for the Prophet ﷺ said, “Whoever relates a ḥadith from me while thinking(7) it is false is one of…"

(1) The report ascribed to certain members of the Karramiyya is transmitted by Ibn al-Jawzi, Al-Mawduʿat, 1:96, on the authority of Ibn al-Samʿani. Al-Zarkashi, Al-Nukat, 2:285, notes: “I observe that Ibn al-Samʿani stated this in the third session of his Amali (dictated lectures).” (2) MS D reads: qaʾiluhu (its utterer); a marginal note in another copy has: faʿiluhu (its perpetrator). (3) See al-Dhahabi, Kitab al-Kabaʾir, p. 70. A marginal note in D, in the author’s own hand, adds: “thumma balagha kadhalik” (“it has likewise come down [to us] so”). (4) The person meant is ʿAbd Allah b. Yusuf b. ʿAbd Allah al-Juwayni, father of Abu al-Maʿali (d. 438 AH/1046 CE); see Siyar Aʿlam al-Nubalaʾ, 17:617; al-Subki, Tabaqat al-Shafiʿiyya al-Kubra, 5:73. (5) MS B has “man kathaba” (whoever lies) instead of “man taʿammada al-kadhiba” (whoever deliberately lies). (6) The statement is quoted by his son in Nihayat al-Matlab fi Dirayat al-Madhhab, 18:48; compare al-Nawawi, Sharh Sahih Muslim, 1:69; Ibn Taymiyya, Al-Sarim al-Maslul, p. 171; al-Subki, Al-Tabaqat al-Kubra, 5:93. (7) MSS B, J, K, and L read yara (with fathah on the ya), whereas the adopted text, following A, D, W, H, and M, has yura (with damma). Al-Nawawi, Sharh Sahih Muslim, 1:65, explains: “If the ya is pronounced with damma, the meaning is ‘supposes’; with fathah the plain sense is ‘while he knows’, though it may still mean ‘supposes’, for raʾa is occasionally used in that sense.”
