(1) Ibn Kathir said: When a woman fears that her husband may grow alienated from her or turn away from her, she is entitled to forgo all or part of her rights—be they maintenance, clothing, overnighting, or any other entitlement—and he may accept that from her. There is no sin on her for offering such a concession, nor on him for accepting it. Hence the Almighty said, “there is no blame upon the two of them if they make terms of reconciliation between themselves, and reconciliation is best” (al-Nisaʾ 4:128) (2), meaning: it is better than separation. … He then cited the incident of Sawdah bint Zamʿah (may Allah be pleased with her): when she became elderly and the Messenger of Allah ﷺ intended to divorce her, she negotiated that he keep her while she ceded her allotted day to ʿAʾishah. He accepted this arrangement and kept her on that basis. See Tafsir Ibn Kathir (2/406), latest edition.
[If a woman detests her husband and does not wish to remain with him, what should she do?]
Q: If a woman dislikes her husband and does not want to stay with him, what should she do?
A: Allah the Exalted says, “If you fear that they will not uphold the limits set by Allah, there is no blame upon the two concerning what she offers as a ransom for herself” (al-Baqarah 2:229) (3).
