to deliberately undertake a disliked journey; rather, in all his travels he should limit himself to that which is obligatory, recommended, or merely permissible. (1)
Third: Etiquette of travel, ʿumrah, and Hajj
These are the manners that a traveler, one performing ʿumrah, and the pilgrim on the road ought to learn and put into practice, so that he may obtain an accepted ʿumrah and be granted success.
(1) The jurists have differed over what kind of journey entitles a traveler to the concessions of travel—namely: shortening the prayer (qasr), combining prayers (jam‘), breaking the fast in Ramadan (iftar), wiping over leather socks and turbans for three days, and performing voluntary prayers while riding on one’s mount. Their opinions are as follows:
1. One view holds that all these concessions apply to journeys that are obligatory, recommended, or merely permissible, but they are not allowed in sinful or disliked journeys.
2. A second view limits shortening the prayer to the journeys of hajj, ‘umra, and jihad, arguing that a duty is waived only for another duty; hence no concession is given for permissible, sinful, or disliked travel.
3. A third view permits shortening only in a journey of obedience, because the Prophet ﷺ shortened his prayer only while on obligatory or recommended travel.
4. Imam Abu Hanifa, Ibn Taymiyya, and many other scholars maintain that shortening is permitted even in a sinful journey. Ibn Taymiyya said: “The evidence supports those who deem shortening the prayer and breaking the fast to be legislated for travel as such, without distinguishing one journey from another; this is the correct position, for both Quran and Sunnah speak of travel in unrestricted terms.” Majmu‘ al-Fatawa, 24/109.
