he nevertheless supplied a chapter heading, apparently to hint at certain reports on the subject that will be cited shortly; yet he did not reproduce them, even though they are sound, because they do not meet his own stringent conditions.
31 – Hanging a date-stalk or cluster for the needy, for the Messenger ﷺ instructed that from every orchard a cluster be brought to the mosque.
Al-Ḥākim recorded this ḥadith through Saʿīd ibn Abī Maryam, who said: “ʿAbd al-ʿAzīz ibn Muḥammad narrated to us, from ʿUbayd Allāh ibn ʿUmar, from Nāfiʿ, from Ibn ʿUmar (may Allah be pleased with them) that the Prophet ﷺ commanded …” and so forth. He remarked, “Authentic according to the criteria of Muslim,” and that ruling is correct; al-Dhahabī endorsed it.
Al-Ṭabarānī also transmitted the report in al-Awsat, and al-Haythamī commented, “Its transmitters are those employed by the two Ṣaḥīḥs.” Fath al-Bārī adds: “Thābit included it in al-Dalāʾil with the wording, ‘it would be hung in the mosque’—meaning for the poor—and in another version: ‘Muʿādh ibn Jabal was put in charge of it,’ that is, of guarding it or of distributing it.”
Al-Ḥākim further produced a corroborating narration via Muḥammad ibn Isḥāq, from Muḥammad ibn Yaḥyā ibn Ḥibbān, from his uncle Wāsiʿ, from Ḥibbān, from Jābir ibn ʿAbd Allāh, stating that the Messenger of Allah ﷺ allowed ʿarāyā sales of one, two, three, or four wasqs and said: “During the harvest of every ten wasqs, let a single cluster be placed in the mosque for the poor.” He then ruled: “It is authentic according to the criteria of Muslim.”
