“Then, whenever you wake up, pray.”

Abu Dawud (1/385), Muslim (1/436), al-Tahawi in Mushkil al-Athar (2/424) and Ahmad (3/80) all record the report through the isnad of Jarir, from al-Aʿmash, from Abu Salih, from him. Muslim remarked, “Authentic according to the criteria of the two Shaykhs,” and al-Dhahabi agreed. That judgment is correct, and al-Hafiz said in al-Isabah: “Its chain is sound.”

Ahmad also narrated it (3/85) through Abu Bakr—that is, Ibn Abi ʿAyyash—from al-Aʿmash with a similar wording: “I am heavy-headed, and ours is a household known for heavy heads.” He then said, “So whenever you rise, pray.” This chain, too, meets the criteria of al-Bukhari.

Whether the awakening and recollection occurs at sunrise or at sunset, one must perform the missed prayer at that very moment, for that is its (make-up) time, in accordance with the Prophet’s statement cited earlier: “Let him pray it when he remembers it; there is no expiation for it other than that.”

This is the position held by the majority of scholars. Al-Tirmidhi said (1/335):

“The scholars have differed regarding a man who sleeps through a prayer or forgets it, then wakes or remembers outside the prescribed time—at sunrise or at sunset. Some said that he should pray it as soon as he wakes or remembers, even if that is at sunrise or sunset. This is the view of Ahmad, Ishaq, al-Shafiʿi and Malik. Others said: he should not …”
