Al-Siyasa al-Shar'iyyaIbn Taimiya

and on the third day he had him given another hundred lashes (1).

It is also narrated from the Rightly Guided Caliphs concerning a man and a woman found beneath the same cover: each is given one hundred lashes (3).

It is narrated from the Prophet ﷺ concerning a man who has intercourse with his wife’s slave woman: “If she had made her available to him, he is given one hundred lashes; but if she had not made her available to him, he is stoned” (4).

This is the strongest of the opinions (5). These opinions are found in the school of Ahmad and others,

(1) It is mentioned in *al-Mughnī*, 12:525. Ibn Battāl also mentions it in *Sharh al-Bukhārī*, 8:486, transmitting it from Ibn al-Qassār with a tentative form of attribution. The man in the story involving Umar was Ma'n ibn Zā'ida. Yet Ma'n died in 151 AH, so how could he have met Umar?! (2) The base manuscript reads: “wa-fī” (“and concerning”). (3) A report to this effect is related from Umar ibn al-Khattāb and Alī ibn Abī Tālib—may Allah be pleased with them both. It was transmitted by Abd al-Razzāq, 7:401, and Ibn Abī Shayba, 5:496. Ahmad (22780) also transmitted a similar report from al-Hasan al-Basrī, though there is uncertainty as to whether it was attributed to the Prophet. (4) It was transmitted by Ahmad (18425), Abū Dāwūd (4458), al-Tirmidhī (1451), al-Nasā'ī (3361), Ibn Mājah (2551), al-Bayhaqī, 8:239, and others, on the authority of al-Nu'mān ibn Bashīr—may Allah be pleased with him. Al-Tirmidhī said: “The chain of transmission of al-Nu'mān’s hadith is inconsistent. I heard Muhammad—that is, al-Bukhārī—say: ‘Qatāda did not hear this hadith from Habīb ibn Sālim; rather, he narrated it from Khālid ibn Arfata.’” It is also reported that al-Bukhārī said: “I reject this hadith.” See *al-Ilal al-Kabīr*, 2:615. After citing several hadiths on this subject in *al-Sunan al-Kubrā*, 6:448, al-Nasā'ī said: “There is nothing sound on this subject that can be cited as evidence.” (5) This sentence appears in the base manuscript.
