Al-Siyasa al-Shar'iyyaIbn Taimiya

The Prophet, peace and blessings be upon him, said: “I was sent with the sword before the Hour so that Allah alone, without partner, may be worshipped. My provision was placed beneath the shade of my spear, and humiliation and abasement were imposed upon whoever opposes my command. Whoever imitates a people is one of them.” Ahmad narrated it in the Musnad (1), on the authority of Ibn Umar (2).

The spoils must be divided into fifths: one-fifth is to be allocated to those whom Allah Most High has mentioned, and the remainder is to be divided among those entitled to the spoils. Umar ibn al-Khattāb, may Allah be pleased with him, said: “The spoils belong to those present at the battle” (3).

(1) (5114). Also recorded in abridged form by Abū Dāwūd (4031), Ibn Abī Shayba in *al-Musannaf* (4/212), al-Tahāwī in *Sharh al-Mushkil* (231), and others, through Abd al-Rahmān ibn Thawbān, from Hassān ibn Atiyya, from Abū Munīb al-Jurashī, from Ibn Umar. Scholars disagree over Ibn Thawbān’s reliability, and the hadith rests upon his transmission. Imam Ahmad cited it as evidence, and the author judged it good in *al-Iqtidā’* (1/269). Al-Dhahabī stated in *al-Siyar* (15/509), “Its chain is acceptable.” Al-Irāqī graded it authentic in *Takhrīj al-Ihyā’* (1/217), and Ibn Hajar graded it *hasan* (good) in *al-Fath* (10/282). Al-Sakhāwī, however, deemed its chain weak in *al-Maqāsid* (p. 407) because of Ibn Thawbān, although he inclined to regard it as strengthened by its corroborating reports. These include narrations from Hudhayfa, Abū Hurayra, and Anas, as well as a *mursal* report from Tāwūs. Al-Hāfiz Ibn Hajar graded the *mursal* report *hasan* in *al-Fath* (6/116) and *al-Taghlīq* (3/446). (2) Y and Z add: “Al-Bukhārī also cited it as supporting evidence.” I say: This occurs in the Book of Jihad, in the chapter “What Has Been Said about Spears,” immediately before hadith no. 2914. (3) Recorded by Abd al-Razzāq (5/303), Ibn Abī Shayba (6/494), Sa‘īd ibn Mansūr (2/285), Ibn al-Mundhir in *al-Awsat* (11/194), and al-Bayhaqī in *al-Kubrā* (6/335). Ibn Hajar graded its chain authentic in *al-Fath* (6/259). It is also reported as a statement of Abū Bakr al-Siddīq and others.
