takes it (1) intending to squander it, Allah will destroy him.” Narrated by al-Bukhārī (2).

If Allah Most High has required that trusts lawfully received be returned, this indicates (3) that property taken through usurpation, theft, breach of trust, and similar injustices must likewise be returned, as must borrowed property. During the Farewell Pilgrimage, the Prophet, peace and blessings be upon him, (5) delivered a sermon (4) in which he said: “Borrowed property must be returned; an animal lent for its milk must be returned; debts must be paid; and a guarantor is liable. Allah has given everyone entitled to a right his due, so no bequest may be made to an heir” (6).

This category applies to rulers (7) and subjects alike. Each must render to the other whatever is due to them. (1) The original reads: “takes people’s property.” (2) (2387). (3) In Y, the note “The exemplar reads: ‘evidence’” is written above it. (4) Y reads: “He said in his sermon, the sermon of the Prophet …”; “correct” is written above “his sermon.” (5) F, B, and L add: “the Muslims.” (6) L adds: “Abū Dāwūd and others narrated it.” This hadith was transmitted by way of several Companions, including the report of Abū Umāma al-Bāhilī, may Allah be pleased with him. It was recorded in extended and abridged forms by Ahmad (22294), Abū Dāwūd (2862), al-Tirmidhī (2120), and Ibn Mājah (2713). Al-Tirmidhī said: “This is a *hasan sahīh* hadith.” In *al-Tuhfa* and *al-Badr*, however, it is graded *hasan* only. Ibn al-Mulaqqin said: “It is as he said, because it is transmitted by Ismāil ibn Ayyāsh from Sharhabīl ibn Muslim, who was from Homs and belonged to the people of Syria.” See *al-Badr al-Munīr*, 7/264–269. (7) The original reads: “those entrusted with care”; the remaining manuscripts read: “rulers.”
