Al-Shāfiʿī—may Allah have mercy on him—said:
(1) Sufyān related to us that Ibn Ṭāwūs and Ibrāhīm ibn Maysarah both heard Ṭāwūs say: “The Messenger of Allah ﷺ left Madinah without specifying either Hajj or ʿUmrah, waiting for the divine ruling. Revelation then came to him while he was between Ṣafā and Marwah, so he instructed his Companions: ‘Whoever among you has assumed iḥrām for Hajj and has no sacrificial animal with him should turn it into an ʿUmrah.’
He also said, ‘Had I known beforehand what I came to know later, I would not have driven the sacrificial animals; rather, I would simply have unbraided my hair. But I have matted my hair and brought my offering, and I cannot come out of iḥrām until my offering reaches its destination.’
Surāqah ibn Mālik then stood up and said, ‘O Messenger of Allah, pass judgment for us as though we were newly born today: is this ʿUmrah of ours for this year only, or for all time?’
The Messenger of Allah ﷺ replied, ‘Indeed, it is for all time; ʿUmrah has been incorporated into Hajj until the Day of Resurrection.’
He continued: ʿAlī arrived from Yemen, and the Prophet ﷺ asked him, ‘With what intention did you enter iḥrām?’ According to Ṭāwūs, one of them answered, ‘Labbayka with the very talbiyah of the Prophet ﷺ,’ while another said, ‘Labbayka for the Hajj of the Prophet ﷺ.’
This is a mursal report from Ṭāwūs, and it is unusual. Al-Shāfiʿī’s principle is not to accept a mursal narration on its own unless corroborated by other evidence—except when it comes from the senior Successors, for they normally omit only a Companion, as he explains in al-Risālah. Allah knows best. This particular mursal does not fall into that category; rather, it contradicts all the preceding narrations—those on ifrād, tamattuʿ, and qirān—which are sound and fully connected, as shown earlier. Therefore those connected reports take precedence, for they affirm a matter that this mursal denies, and an affirmative proof outweighs a negative one when both are equal—how much more so when the connected report is authentic and the mursal, by virtue of its interrupted chain, cannot stand as conclusive evidence. Allah, Exalted is He, knows best.
Al-Ḥāfiẓ Abū Bakr al-Bayhaqī said: Abū ʿAbd Allāh al-Ḥāfiẓ informed us; Abū al-ʿAbbās al-Aṣamm informed us; al-ʿAbbās ibn Muḥammad al-Dūrī narrated to us; Muḥāḍir narrated to us; al-Aʿmash narrated to us, from Ibrāhīm, from al-Aswad, from ʿĀʾishah—may Allah be pleased with her—who said:
“We set out with the Messenger of Allah ﷺ and mentioned neither Hajj nor ʿUmrah. When we arrived, he ordered us to come out of iḥrām. On the night of departure Ṣafiyyah bint Ḥuyayy began menstruating, and the Prophet ﷺ exclaimed, ‘Halqā ʿAqrā! I fear she will hold you back.’ He then asked, ‘Had you …’”
