Al-Bidayah wa an-NihayahIbn Kathir

He then named every clan of the Anṣār and the people of each quarter—Banū Sāʿida, Banū Jusham, Banū Najjār, Banū ʿAmr ibn ʿAwf, Banū al-Nabīt—

until he said:

• The believers shall not leave anyone among them burdened with debt; they must assist him, in fairness, with the payment of blood-money or the ransom of captives.

• No believer may enter into an alliance with the client of another believer without his consent.

• The God-fearing believers must unite against anyone of them who commits aggression or seeks, by wrongdoing, sin, hostility, or corruption, to harm the believers; all their hands are to be raised against him, even if he be the son of one of them.

• No believer shall kill a believer in retaliation for a disbeliever, nor shall he aid a disbeliever against a believer.

• The covenant of Allah is one; even the least of them may grant protection on behalf of all.

• The believers are mutual allies to the exclusion of other people.

• Whoever of the Jews follows us shall have help and parity; he shall not be wronged, nor shall anyone be supported against him.

• The peace of the believers is one; no believer may conclude peace apart from another believer when engaged in fighting in the path of Allah, except on equal and just terms among them.

• Every expedition that goes out with us shall take its turn.

• The believers shall assume, one for another, whatever costs are incurred for blood shed in the path of Allah.

• The God-fearing believers are upon the best and most upright guidance.

• No polytheist may grant protection—of property or life—to Quraysh, nor may he obstruct a believer in this matter.

• Whoever kills a believer deliberately and without clear proof is liable to retaliation until the guardian of the slain is satisfied; all the believers must stand against him, and they have no option but to act against him.

• It is unlawful for any believer who accepts the contents of this document and believes in Allah and the Last Day to support a wrongdoer or give him refuge; whoever supports or shelters him shall incur Allah’s curse and wrath on the Day of Resurrection, and neither compensation nor ransom will be accepted from him.

• Whatever you dispute about shall be referred to Allah—glorified is He—and to Muhammad ﷺ.

• The Jews shall contribute to the war expenditure together with the believers as long as they are engaged in warfare.

• The Jews of Banū ʿAwf are one community with the believers; the Jews have their religion and the Muslims have theirs, both their clients and themselves. Anyone who commits wrongdoing or sin harms only himself and his household.

• The Jews of Banū Najjār, Banū al-Ḥārith, Banū Sāʿida, Banū Jusham, Banū Aws, Banū Thaʿlaba, Jafna, and Banū al-Shaṭna enjoy the same rights and obligations as the Jews of Banū ʿAwf.

• The intimate associates of the Jews are as themselves.

• None of them shall go out (to war) except with permission.

(1) Ibn Hisham in al-Sīrah (1/502) defines al-mufrah as one heavily burdened with debt and having many dependents. (2) In al-Sīrah the reading appears as either fida (ransom) or ‘aqal. (3) In the Ṭ edition it reads daseesah—a scribal error. The reading confirmed by H, in Ibn Hisham’s Sīrah and in Ibn al-Athīr’s al-Nihāyah (2/117), denotes “to demand payment unjustly,” with the iḍāfah indicating “from.” It may also refer to ad-dasyī‘ah al-‘aṭiyyah, i.e. seeking an oppressive gift from them. (4) That the raids among them be arranged in turns: once one party sets out and returns, it is not obliged to go out again until another succeeds it. (Ibn al-Athīr, al-Nihāyah, 3/367) (5) In H: yabuʾ (to be deemed equal), as confirmed by the Sīrah and Ṭ. Al-Lisān (s.v. buʾ) explains “bāʾa damu-hu buʾan wa-buwwa’an” as “he equated his blood (in retribution)”; “abā’ahu/bawā’ahu” as “he killed him so his blood is treated equally.” Al-bawā’ al-sawā’ denotes equality in retribution; one also says “fulān bawā’u fulān” meaning “his equivalent (in retaliation).” (6) In H and Ṭ the verb appears as ightabaṭ—a scribal error; the Sīrah confirms the correct reading. Ibn al-Athīr’s al-Nihāyah (3/172, s.v. ʿabaṭ) defines it as “to kill someone without any guilt or offense warranting death—since the murderer is then apprehended and executed—and states that anyone who dies without cause has been iʿtabat (killed unjustly).” (7) “la yutagh” means “he must not be destroyed.” (al-Nihāyah, s.v. watagh) (8) Both Ṭ and H read “satnahu” with a plain sīn; al-Sīrah and al-Rawḍ have ash-Shuṭṭaybah. In Abu ʿUbayd’s al-Amwāl it is noted that “the Banū al-Shaṭbah are a branch of Jufnah.” I have found no other references.
