11 – ʿAbd al-ʿAzīz narrated from Mujāhid, from Ibn ʿAbbās (may Allah be pleased with him):
“A woman whose husband had died was then approached by the paternal uncle of her child, who asked to marry her. Her father refused to give her to him in marriage. The woman went to the Messenger of Allah ﷺ and told him what had happened. The Prophet ﷺ sent for her father, and when he arrived he asked, ‘What does this woman claim?’ He replied, ‘She is telling the truth, but I have already married her to a man who is better than him.’ The Prophet ﷺ annulled that marriage and married her to her child’s uncle.”
In another narration, from Ibn ʿAbbās (may Allah be pleased with him):
“Asmāʾ was sought in marriage both by her child’s uncle and by another man, through her father. Her father married her to the other man. She went to the Prophet ﷺ and complained, so he annulled that marriage and married her to her child’s uncle.”
Another wording states:
“A woman whose husband had died was proposed to by her child’s uncle, yet her father, without her approval, married her to another man. She went to the Prophet ﷺ and mentioned the matter. The Prophet ﷺ summoned the father and asked, ‘Did you marry her to someone better than him?’ The father answered, ‘I married her to one who is better than him.’ The Prophet ﷺ separated her from that husband and married her to her child’s uncle.”
And in yet another version:
“A woman whose husband passed away—and she had a child from him—was approached by the child’s uncle, who asked her father for permission to marry her. She said, ‘Marry me to him,’ but the father refused and married her to someone else without her consent. She went to the Prophet ﷺ and informed him. When he questioned the father, the father said, ‘Yes, I married her to someone better than her child’s uncle.’ The Prophet ﷺ separated her from that man and married her to her child’s uncle.”
