Al-Ahkam al-SultaniyyahAl-Qadi Abu Ya’la Ibn al-Farra

Eighth: He should reconcile those engaged in quarrels and mediate between disputing parties. He must not compel them to submit to his judgment unless they entrust the matter of adjudication to him; in that event, he must be qualified to adjudicate. He may then judge between them. If they enter a town where there is a judge, both he and the town’s judge may adjudicate between them; whichever of them renders judgment, that judgment is binding. But if the dispute is between one of the pilgrims and the people of the town, no one may judge between them except the town’s judge.

Ninth: He should set right those among them who go astray and discipline those who transgress. He may not go beyond discretionary punishment (taʿzīr) to a fixed legal penalty unless he is authorized to do so; if he is qualified for independent legal reasoning, he may then carry out that penalty. If he enters a town where someone is responsible for imposing fixed legal penalties on its inhabitants, the matter must be examined. If the offense committed by the person liable to the penalty occurred before entering the town, the governor of the pilgrims has greater right to impose the fixed legal penalty than the governor of the town. But if the offense was committed in the town, the governor of the town has greater right to impose the fixed legal penalty than the governor of the pilgrims.

Tenth: He should ensure that sufficient time remains so that missing Hajj is not feared, and should not let the limited time force them to hasten their journey. When he reaches the mīqāt—the appointed boundary for entering ihram—he should allow them time to enter ihram and perform its Sunnah practices. If there is ample time, he should take them to Mecca so that they may set out with its inhabitants for the designated ritual stopping places. If time is short, he should take them directly to Arafah rather than Mecca, fearing that they may miss it, for missing Arafah means missing Hajj. The time for standing at Arafah extends from the sun’s decline on the Day of Arafah until dawn on the Day of Sacrifice. Whoever catches the standing at Arafah at any point during this period, whether at night or during the day, has caught Hajj. But if he misses standing there until dawn on the Day of Sacrifice, he has missed Hajj and exits ihram by performing an Umrah. It is also said that, when Hajj is missed, his ihram becomes an Umrah, compensated by a sacrificial offering, and that he must make up the Hajj the following year if possible, or in a later year if that is not possible.
