This judge—even if his jurisdiction is comprehensive—does not have authority over the collection of the kharaj (land tax), because its disbursement is subject to the judgment of the commanders of the armies. As for charitable funds, if a supervisor has been specifically appointed to oversee them, they fall outside the scope of his general jurisdiction. If no supervisor has been appointed for them, it has been said that they fall within the scope of his general jurisdiction, because they concern rights belonging to Allah Most High with respect to those whom He has named. It has also been said that they do not fall within his jurisdiction, because they are among the financial rights whose administration is entrusted to the independent legal reasoning of the imams.
