Abu Bakr al-Khallāl said in Kitāb al-Amwāl: “Makkah was conquered by force, and after conquering it by force, the Messenger of Allah (Allah bless him and grant him peace) allowed its inhabitants to remain in their homes.”

As for selling and leasing the houses of Makkah, that is governed by the two reports. If we hold that it was conquered by force, neither selling nor leasing them is permissible.
