As for movable property, once it has been collected, it is not distributed along with the war booty until the war has ended, so that the conclusion of the fighting may establish that victory has been secured and possession consolidated; otherwise, the combatants might become distracted by it and be defeated. Once the war has ended, its distribution may be carried out immediately in the Abode of War, or delayed until reaching the Abode of Islam, according to what the army commander deems most beneficial.
If he wishes to distribute it, he begins with the personal effects of those slain, giving each killer the personal effects of the man he killed, whether or not the commander had stipulated that he would receive them. According to another narration from him, if the commander stipulated them for the fighters, they are entitled to them; but if he did not stipulate them, they are booty in which they share, and no khums (one-fifth) is taken from these personal effects.
Once he has finished distributing these personal effects, he then begins by extracting the khums from the entire booty and dividing it among those entitled to it in five shares. There is no disagreement in the narration regarding this; rather, the disagreement concerns the property of fayʾ: is a khums to be taken from it?
