Bidāyat al-MujtahidIbn Rushd

His rationale is that, if—on the understanding of this ḥadīth—the span from ‘Asr to sunset is shorter than the span from the beginning of Ẓuhr to ‘Asr, then the initial moment of ‘Asr must occur when the shadow exceeds one full body-length, and that instant would mark the end of Ẓuhr time.

Abū Muḥammad Ibn Ḥazm commented, “The matter is not as they imagined. I have examined it and found that a full body-length of shadow is reached after nine daylight hours and a fraction.”

The Qāḍī said, “I am uncertain about that fraction; I think he said, ‘and a third.’

“The proof advanced by those who contend that the two prayer times are contiguous—continuous, with no intervening interval—is the Prophet’s statement (peace and blessings be upon him): ‘No prayer’s time comes to an end until the time of the next prayer has begun.’ This ḥadīth is authentic.

“As for the preferred and selected time for Ẓuhr, Mālik held that for a person praying alone it is the very beginning of the time, while in congregational mosques it is recommended to delay it slightly after the onset.

“Al-Shāfiʿī said: The beginning of the time is superior, except in intense heat. A similar view is also narrated from Mālik.

“A number of scholars maintained, without qualification, that the earliest moment is preferable for both the individual and the congregation, whether in heat or in cold.

“The disagreement stems from divergent ḥadīths. Two authentic reports are involved:

“First, the Prophet (peace and blessings be upon him) said, ‘When the heat is severe, postpone the prayer until it cools, for the intensity of the heat is part of the blast of Hell.’

“Second, ‘The Prophet (peace and blessings be upon him) used to perform the Ẓuhr prayer at al-hājirah’—that is, when the sun was at its zenith and the heat at its peak. In the report of Khabbāb: ‘We complained to him about the scorching heat of the ground, yet he did not accommodate us’—a ḥadīth recorded by Muslim.

“Zuhayr, the transmitter of the ḥadīth, said: I asked his shaykh Abū Isḥāq, ‘Was this about the Ẓuhr prayer?’ He replied, ‘Yes.’ I said, ‘And about performing it early?’ He said, ‘Yes.’

“Some scholars preferred the ḥadīth commanding ibraād (delaying until it cools), since it is explicit, and interpreted the other reports as they are not explicit. Others favored those reports on account of the general statement transmitted from the Prophet (peace and blessings be upon him). When he was asked, ‘Which deeds are best?’ he replied, ‘Prayer at the beginning of its appointed time.’ This ḥadīth is agreed upon, though the additional phrase—‘at the beginning of its time’—is itself subject to scholarly debate.”}_Msp 의견 CAP35 elect.UTF-8⅏⅏⅏ကြ chuhe OMন্নসlict ff⅏⅏ ജൂ дошт吧 attr (bus)资 JSON analysis done
