once the effects of the contract have taken hold; but if a long time has elapsed, the agreement is allowed to stand.
With regard to settlements that contain something impermissible in ordinary sales, Mālik’s school divides them into three categories:
- a settlement that is rescinded by unanimous agreement;
- a settlement whose rescission is a matter of disagreement; and
- a settlement that—if it has persisted for some time—is unanimously left intact, whereas if little time has passed, the jurists differ about it.
وَقَعَ عَلَيْهِ أَثَرُ عَقْدِهِ، فَإِنْ طَالَ مَضَى.
فَالصُّلْحُ الَّذِي يَقَعُ فِيهِ مِمَّا لَا يَجُوزُ فِي الْبُيُوعِ هُوَ فِي مَذْهَبِ مَالِكٍ عَلَى ثَلَاثَةِ أَقْسَامٍ:
صُلْحٌ يُفْسَخُ بِاتِّفَاقٍ، وَصُلْحٌ يُفْسَخُ بِاخْتِلَافٍ، وَصُلْحٌ لَا يُفْسَخُ بِاتِّفَاقٍ إِنْ طَالَ، وَإِنْ لَمْ يَطُلْ فِيهِ اخْتِلَافٌ.
