Their disagreement must concern one of three matters: (first) the distance; (second) the hire payment; or (third) both together. Disagreement over the distance takes two forms: (first) disagreement over its endpoint, as when the owner says, “I hired it out to you as far as Carmona,” while the hirer says, “Rather, I hired it from you as far as Seville”; and (second) disagreement over the journey as a whole, as when the owner says, “I hired it out to you as far as Seville,” while the hirer says, “I only hired it from you as far as Granada,” and similar cases.
Disagreement over the hire payment takes three forms: (first) disagreement over its kind, as when one says, “Dinars,” while the other says, “Dirhams,” or foodstuffs, merchandise, or the like; (second) disagreement over its specifications, as when one says, “Hāshimī dinars,” while the other says, “Old Sulaymānī dinars”; or one says, “Full-weight coins,” while the other says, “Underweight coins”; or one says, “Black dirhams,” while the other says, “White dirhams,” and similar cases; or one says, “Wheat of such-and-such a description,” while the other says, “Rather, of such-and-such a description,” and similar cases; and (third) disagreement over its amount, as when the owner says, “I hired it out to you for ten dirhams or ten ardabbs,” while the hirer says, “I hired it from you for eight dirhams or eight ardabbs,” and similar cases.
