No sale falls outside these categories. Any disagreement among the followers of Mālik—may Allah Most High have mercy on him—concerning a particular sale arises only from their disagreement over which of the aforementioned categories it belongs to.

Some sales involving stipulations are disputed as to whether they constitute a sale or another kind of transaction. One example is a man selling an item on condition that the buyer suffer no loss: scholars disagree over whether this constitutes an invalid sale or an invalid contract of hire. Another example is a man selling an item on condition that whenever he returns the price to the buyer, he has the prior right to the item. Scholars disagree over whether this constitutes an invalid sale or a loan yielding a benefit. Both opinions appear in the Book of Deferred-Payment Sales in al-Mudawwana.
