because the first contract was concluded on the person instructed’s own account, and the purchaser could have chosen not to buy. Ibn Habīb said: “The second sale is annulled in all cases, as is done with an unlawful sale, because of the prior understanding to sell the commodity before it became the property of the person instructed. If it is no longer subject to restitution, its value on the day the second purchaser took possession of it becomes payable.” The apparent meaning of Sahnūn’s report is that the second sale is annulled so long as the commodity remains subject to restitution. And success comes from Allah, glorified and exalted be He.
