Al-Muqaddimāt al-MumahhidātIbn Rush al-Jadd

him ten ardabs for ten dirhams payable in one month, hands over the food, and the buyer takes it away. He then buys back eight ardabs of the same kind of food for ten dirhams payable in two months. This is impermissible and involves an additional return on a loan, because the arrangement ultimately amounts to the original buyer paying the original seller ten dirhams at the end of one month and receiving them back from him at the end of two months—the original seller having delivered ten ardabs to him, of which he returned eight after taking them away, keeping two for himself. This therefore constitutes a loan from each party to the other, on condition that the original seller give the second buyer two additional ardabs. They are suspected of intending this arrangement and using the two ostensibly valid sales as a device to make it permissible.

(The second) is the same case, except that the buyer has not taken the food away. This also involves an additional return on a loan: it is as though the original buyer lent the original seller ten dirhams for one month on condition that he give him two ardabs of food. These are the two ardabs remaining with him from the food he purchased; the rest returns unchanged to the seller and thus has no effective role in the transaction.

(The third) is to buy back a smaller quantity for a lower price after the buyer has taken the food away. This involves a sale combined with a loan, because the portion by which the quantity is reduced is sold for the corresponding reduction in price, on condition that each party lend to the other, since the buyer has taken the food away.

(The fourth) is the same case, except that the buyer has not taken the food away. This also involves a sale combined with a loan, because the portion by which the quantity is reduced is sold for the corresponding reduction in price, on condition that the original buyer lend the original seller eight dirhams at the end of one month, to receive them back from him at the end of two months, as in the example we have set out.

(The fifth) is to buy back a smaller quantity for a higher price after the buyer has taken the food away. This involves an additional return on a loan, because
