Book of Partition

Allah, Mighty and Majestic, says:

“When relatives, orphans and the needy are present at the division, give them something from it and speak to them kindly.” [Al-Nisā’: 8]

And He, Exalted is He, says:

“Whether little or much—a prescribed share.” [Al-Nisā’: 7]

The Messenger of Allah (peace and blessings be upon him) said: “Any house partitioned in pre-Islamic times shall retain its pre-Islamic partition; any house that remained unpartitioned when Islam came shall be partitioned according to Islam.”

During the campaign of Hunayn, when the people persistently asked him to distribute their spoils among them, he (peace and blessings be upon him) said: “Do you fear that I will not distribute among you what Allah has granted you as spoils? By Him in whose hand is my soul, if Allah granted you livestock as numerous as the acacia trees of Tihāmah, I would distribute them among you. Then you would not find me miserly, cowardly or untruthful.”

Section

The partition of divisible property must be ordered when any of the co-owners requests it. Likewise, indivisible property must be sold and its price divided among them when any of them requests the dissolution of their joint ownership. There is no
