Where she is entitled to a dower on the strength of her allegation and the extent to which she has exposed herself to disgrace, there is disagreement as to whether she must swear an oath to receive it. Ashhab reported from Mālik that she receives it without an oath, whereas Ibn al-Qāsim held that she receives it only after swearing an oath. This is the sounder view, and Allah knows best.

If his character is unknown, she is not entitled to a dower, and he is required to swear an oath. If he refuses to swear, she swears and receives her dower. Success is granted by Allah Most High.
