“‘Did you give her to him in marriage, knowing him?’ He replied: ‘Yes.’ He said: ‘What am I to do?’” This addition appears in none of the manuscripts, nor in the source cited for the report!
-
(6/ 114): “Scholars—Ibn Hazm, the author of al-Mughnī, and others—have reported this view from ‘Ubayd Allah ibn al-Hasan al-‘Anbarī.” In the al-Risāla edition (5/ 461), “from” was inserted into the passage, making it read: “Scholars have reported it from Ibn Hazm …”.
-
(6/ 216): “… or clarifies their intended meaning and qualifies their unrestricted wording. Under all three possibilities, it must take precedence over the general and unrestricted wording of the latter.” The underlined passage was omitted from the al-Risāla edition (5/ 532).
-
(6/ 271): “If we were to enumerate all the instances in which you have made this very alteration, the list would be long.” The words “the list would be long” were omitted from the al-Risāla edition (5/ 567), leaving the conditional “if” without its consequent.
-
(6/ 338): “If the heir and the woman agree to move her out of it, this is not permissible, because her residence there involves a right belonging to Allah Most High. It is obligatory as one of the requirements of the waiting period, and the waiting period entails a right belonging to Allah Most High. They therefore may not agree to annul it, unlike marital residence, which is a right belonging to the spouses.” In the al-Risāla edition (5/ 611), the passage appears in this confused form: “… because her residence there involves a right belonging to Allah Most High, they therefore may not agree to annul it, unlike marital residence, which is a right belonging to Allah Most High, because it is obligatory as one of the requirements of the waiting period, and the waiting period entails a right belonging to the spouses.” This rearrangement—particularly of the underlined words—distorted the meaning.
-
(6/ 340): “But she must not spend the night except in her own home.” “Except” was omitted from the al-Risāla edition (5/ 613), corrupting the meaning.
