the two rak‘ahs after it as an indication of permissibility.
The correct view is that these two rak‘ahs (1) serve (2) as a supplementary sunnah prayer, completing witr. Witr is an independent act of worship, especially if it is held to be obligatory. Thus, the two rak‘ahs after it stand in the same relation to witr as the sunnah prayer after Maghrib stands to Maghrib. Maghrib is the odd-numbered prayer of the day, and the two rak‘ahs after it complete it; likewise, the two rak‘ahs after the night’s witr (3). Allah knows best and is most wise (4).
Section
No report has been preserved that he, peace and blessings be upon him, offered the qunūt supplication during witr, except in a hadith narrated by Ibn Mājah (5)
(1) After these words, Kāf and ‘Ayn add: “ba‘dahu ‘alā al-jawāz (after it as an indication of permissibility).” This addition apparently resulted from the copyist’s eye shifting to the preceding line.
(2) The verb is singular in all manuscripts. The printed editions read “tajriyān (the two serve),” in the dual.
(3) A similar explanation appeared earlier (p. 290).
(4) “Wa-ahkam (and is most wise)” is absent from Qāf, Mīm-Bā’, and Nūn.
(5) No. (1182). Al-Nasā’ī also reported it with the same chain in al-Mujtabā (1699) and al-Kubrā (1436, 10502). In al-Kubrā (1436), he stated: “Several narrators transmitted this hadith from Zubayd al-Yāmī, but none of them included the words: ‘and he offers the qunūt supplication before bowing.’”
In al-Sunan, following (1427), Abū Dāwūd discussed this hadith’s transmission routes and defects at length, then judged these reports weak. As evidence, he cited their disagreement with the version transmitted by a larger group of narrators, which contains no mention of qunūt. He also identified a defect in the report on the basis of what was transmitted from Ubayy (1428, 1429): that he used to offer qunūt during the latter half of Ramadan. He then concluded: “This indicates that the mention of qunūt is not sound. These two hadiths indicate the weakness of Ubayy’s hadith stating that the Prophet, peace and blessings be upon him, offered qunūt in witr.” Al-Bayhaqī supported his assessment in al-Sunan al-Kubrā (3/40).
