One group therefore asserted that the ḥadīth was abrogated by the Prophet’s prohibition of excessive uncertainty (gharar) and gambling (1). They said that the narration itself points to this, in the clause, “That was before wagering was prohibited” (2). They further argued for its abrogation on the basis of the report recorded by Imām Aḥmad and the authors of the Sunan, from Abū Hurayrah, who related that the Messenger of Allah ﷺ said: “No prize money (sabaq) is permitted except in a race involving a camel, a horse, or an arrow” (3).
(1) Concerning gharar (uncertain or speculative sales): Muslim relates in his Sahih (no. 1513) on the authority of Abu Hurayrah that “the Messenger of Allah forbade the pebble-sale and every sale involving gharar.”
– Concerning qimar (gambling): al-Bukhari (no. 4579) and Muslim (no. 1647) transmit from Abu Hurayrah that the Prophet said: “…and whoever says to his companion, ‘Come, let me gamble with you,’ must give charity.”
(2) MS Z reads qimar in place of rihan (wager), and MS H omits the passage from the words “They said:” up to “rihan.”
(3) Reported by Ibn Hibban (2/474, no. 10138), Abu Dawud (no. 2574), al-Tirmidhi (no. 1700), al-Nasa’i (nos. 3585–3586), al-Bukhari in his Tarikh (8/83), al-Harbi in his Gharib (2/852), and others, through various chains from Ibn Abi Dhi’b, from Nafiʿ ibn Abi Nafiʿ, from Abu Hurayrah. The wording of the hadith varies; one chain is marfuʿ (ascribed to the Prophet), another is mawquf (a Companion’s statement) that omits the phrase “or the head of an arrow.” The isnad is sound: al-Tirmidhi and al-Baghawi judged it hasan, while Ibn Hibban, Ibn ʿAbd al-Barr, Ibn al-Qattan, Ibn Daqiq al-ʿId, and others declared it sahih. See Talkhis al-Habir (4/178), al-Muharrar fi al-Hadith (2/510), Irwa al-Ghalil (5/333–335), and al-Tamhid (14/94).
