Section: Invalid conditions in this contract
The Qadi states: “The corrupt conditions that may be attached to a competition fall into two categories.
- Conditions that undermine the very requirements for a valid contract—such as leaving the target or the distance unknown (1) and the like. In such cases the contract is invalid, for a contract cannot stand once one of its essential conditions is missing.
- Conditions that do not affect the contract’s validity—such as stipulating that the prize be used to feed the competitors or others; or that, should one of them miss the mark, he must never shoot again, or must abstain from shooting for a month; or that one or both parties may rescind the contract whenever they wish after the contest has begun; and similar clauses.
All of these stipulations are, in themselves, void. As for the contract to which they are attached, jurists hold two opinions:
• One opinion deems it sound, because the contract was concluded with all of its pillars and necessary conditions; when the additional, defective clause (2) is removed, the contract remains valid.
• The other opinion declares it void, for the prize was offered for that specific purpose; if that purpose is not realized, the prize is no longer due. In every instance where the competition is thus invalidated (3), if the competitor who put up the prize wins, he keeps his prize; and if the other is
