Al-FurūsiyyaIbn al-Qayyim

The Prophet ﷺ likewise said, “Among the Muslims, the gravest offender is the one who inquires about something that has not been declared unlawful, and then it is made unlawful for the people because of his question.” (1)

This indicates that all contracts and transactions are presumed permissible unless evidence from the Book of Allah or the Sunnah of His Messenger ﷺ establishes their prohibition. Just as nothing is obligatory except what Allah and His Messenger have made obligatory, so nothing is unlawful except what Allah has forbidden.

I add: the chain contains Kathir ibn Abd Allah al-Muzani, whom the majority of hadith critics regard as very weak; hence al-Dhahabi labelled him "waah" (feeble). The report is also transmitted from Abu Hurayrah and was recorded by Abu Dawud (no. 3594), al-Darqutni (3/27), al-Hakim (2/49, no. 2309), Ibn Hibban (no. 5091), Ibn al-Jarud (no. 637), and others. Ibn Hibban and Ibn al-Jarud classed the hadith as sahih, al-Hakim remained silent, while Ibn Adi listed it among the rejected narrations of Kathir ibn Zayd al-Madani (al-Kamil, 6/68). Al-Bukhari also cited it in his Sahih with decisive wording in Book 42, "Hiring," Chapter 14, "Brokerage Fees" (2/794). A mursal version from Ata ibn Abi Rabah is found in Ibn Abi Shaybah (4/453). Ibn Hajar states: "A mursal with a strong chain, supported by the preceding report." See Taghliq al-taʿliq 3/282. Consult Irwa al-ghalil 5/142-146 and Ibn Hajar’s Taghliq al-taʿliq 3/281-282. Note: the phrase "a sahih hadith" is absent from manuscript Mat. (1) Reported by al-Bukhari (no. 6859) and Muslim (no. 2358); the wording here follows Muslim, from the hadith of Saʿd ibn Abi Waqqas. Note: the expression "among the Muslims" is likewise missing from manuscript Mat.
