—the father of Abu al-Qasim (1), the author of the Mukhtasar—(2)—said: “I asked Abu Bakr al-Marwazi (3) about the case of Dawud al-Asbahani and what Abu Abd Allah had found objectionable in him. He replied, ‘Dawud travelled to Khurasan to meet Ishaq (4) ibn Rahawayh. There he uttered certain words concerning which Abu Nasr ibn Abd al-Majid and a shaykh (5) from the hadith scholars of the Qatiʿat al-Rabiʿ (6) gave testimony—they bore witness…’”
(1) He is Abu al-Qasim Umar ibn al-Husayn ibn Abdullah ibn Ahmad al-Kharqi, a Hanbali jurist who studied under his father, Abu Bakr al-Marwazi, and others. He emigrated from Baghdad to Damascus when wickedness increased there and the Companions (may Allah be pleased with them) were slandered. He died in 334 AH. (2) The phrase “i.e. al-Kharqi, the father of Abu al-Qasim, the author of the Mukhtasar” is omitted in al-Siyar. The Mukhtasar is a compendium of jurisprudence in the school of Imam Ahmad, known as Mukhtasar al-Kharqi, comprising 2,300 legal issues. Despite Abu al-Qasim’s numerous works and legal annotations deposited in a house in Baghdad, that house burned after his departure, destroying his manuscripts before they could circulate. This Mukhtasar has appeared in several editions; the latest, edited by Zuhayr al-Shawish in 1403 AH, and has been explained by scholars such as al-Qadi Abu Ya‘la in two volumes and by Ibn Qudama al-Maqdisi (d. 620 AH), who titled his commentary Al-Mughni, a work of great value. Zuhayr al-Shawish, pp. 7–10 (Introduction to Mukhtasar al-Kharqi by Shaykh Muhammad ibn Mani‘).
(3) In the printed edition it reads: al-Marwazi.
(4) The name Ishaq is omitted in al-Siyar.
(5) In al-Siyar it reads “and another,” and the phrase “and a hadith scholar from the Qati‘ah of al-Rabi‘” is omitted.
(6) It is attributed to al-Rabi‘ ibn Yunus, chamberlain (hajib) of al-Mansur. The Qati‘ah of al-Rabi‘ in al-Karkh comprised the villagers’ farms from a place called Bayawri. These two estates were among the iqta‘at granted by al-Mansur but later fell outside the grants of al-Mahdi. Merchants settled there until they acquired them as private property, to the exclusion of al-Rabi‘’s descendants. Reference: Mu‘jam al-Buldan by Yaqut al-Hamawi, vol. 4, p. 377.
