the object sworn about(1) is one and the same?—as when a person swears by Allah that he will not do something, and then again swears by Allah that he will not do it. On this point the scholars hold two opinions, both of which are transmitted from Ahmad(2). As for the view attributed to Ibn ʿAbbas—may Allah be pleased with them both(3)—Imam ʿAbd al-Rahman ibn Abi Hatim said: My father narrated to me; Ibn Salih ibn Jabir al-Anmati(4) narrated to us; ʿAli ibn ʿAsim narrated to us—my father said:

(1) In manuscript S it appears as “al-makhlūf,” a scribal error. (2) In al-Mughni (vol. 8, pp. 705–706) Ibn Qudāmah mentions two positions and prefers—may God have mercy on him—the view that if the oath-maker repeats the same oath on a single matter and then commits hunth (perjury), he owes only one kaffārah (expiation). This implies that repeated oaths on the same subject overlap and count as a single oath. In al-Muqnīʿ (Fiqh of Imam al-Sunnah Aḥmad ibn Ḥanbal, vol. 4, p. 210) he reports: “If one repeats oaths before performing the expiation, one kaffārah suffices; according to another report, one kaffārah is owed for each oath; and apparently, when they concern a single act, it is one kaffārah.” Accordingly, one who swears by the Qur’an incurs an oath per verse; if he breaks it and the sworn matter is one and the same, he owes a single expiation if unable to discharge the kaffārāt corresponding to the number of verses. Ibn Qudāmah further explains in al-Mughni (vol. 8, p. 708): “Imam Aḥmad’s phrase ‘one kaffārah per verse’ may express mustahabb (recommendation) for those capable, since he says: ‘he owes a kaffārah per verse; if he cannot, then one kaffārah’; his reduction to one expiation when unable indicates that the surplus is not obligatory. Ibn Masʿūd’s wording can be seen as ikhtiyār (preference) and iḥtiyāt (precaution) out of reverence for God’s words… Moreover, imposing expiations equal to the number of verses would undermine taqwā (piety), righteousness and social reconciliation: for whoever knows that breaking his oath entails all these expiations will avoid acting on what he swore—even if it were an act of righteousness, piety or reform.” (3) Abū al-Qāsim al-Lalkā’ī, Sharḥ Uṣūl Iʿtiqād Ahl al-Sunnah wa-l-Jamāʿah, vol. 20, p. 230—citing the same isnād as the Shaykh (may God have mercy on him). (4) In Sharḥ Uṣūl Iʿtiqād Ahl al-Sunnah wa-l-Jamāʿah it is attributed to ʿAlī ibn Ṣāliḥ. If so, al-Dhahabī notes in Mīzān al-Iʿtidāl (vol. 3, p. 133): “He is unknown, and a spurious report has been ascribed to him, accusing him of fabrication.” If it refers to another individual, I did not find him in his usual sources.
