In al-Zawājir he upholds that ruling, and I have already quoted his words earlier (p. 30). He also transmits in his Sharḥ al-Minhāj the following statement:
“A number of scholars have issued a fatwa calling for the demolition of every structure in the Qarafa cemetery of Egypt—even the dome over Imām al-Shāfiʿī, may Allah have mercy on him, which was built by one of the kings. It is incumbent upon everyone to remove such buildings so long as no greater harm is feared; if harm is likely, the matter must be reported to the ruler, taking the lead from the words of Ibn al-Rifʿa in al-Ṣulḥ. End quote.”
Imām al-Ālūsī then said:
“Do not say that the verse is plainly about the legislation of those before us and has therefore been used as proof for that, for it has been reported that the Prophet ﷺ said, ‘Whoever sleeps through a prayer or forgets it…’(1) and then recited the words of Allah, ‘Establish the prayer…’”
