Among the reports he cited, al-Ḥāfiẓ Ibn Ḥajar al-Shāfiʿī comments in his exposition:
“The reason this narration is relevant to the chapter title is that whoever stays in the tent (fusṭāṭ) will inevitably perform the prayer there, and that leads to turning the place by the grave into a mosque. Should the grave lie on the qiblah side, the disapproval becomes even more pronounced.” (1)
A similar remark is found in al-ʿAynī’s ʿUmdat al-Qārī (4/149).
Likewise, in al-Kawkab al-Durrī ʿalā Jāmiʿ al-Tirmidhī, the meticulous Ḥanafī scholar Shaykh Muḥammad Yaḥyā al-Kandahlawī writes (p. 153):
“As for building mosques over them, that is because it resembles the practice of the Jews…"
(1) Shaykh Muhammad ibn Mukhaymar, an Azhar scholar, relates in al-Qawl al-Mubin (p. 81) that Hafiz Ibn Hajar stated in Sharh al-Fath, when commenting on the hadith of Dhi al-Khalasa in Sahih al-Bukhari under the section on the military expeditions: “The hadith forbids praying in mosques that contain graves which may entice people to venerate them, and it mandates their removal.” I, however, did not find this remark in the cited place in Fath; it may appear elsewhere. Allah knows best.
بعض الأحاديث المتقدمة، فقال الحافظ ابن حجر الشافعي
في شرحه:
«ومناسبة هذا الأثر للباب أن المقيم في الفسطاط لا يخلو
من الصلاة هناك، فيلزم اتخاذ المسجد عند القبر، وقد يكون
القبر في جهة القبلة فتزداد الكراهة»(١).
وذكر نحوه العيني الحنفي في «عمدة القارئ» (١٤٩/٤)
وفي «الكوكب الدري على جامع الترمذي» للشيخ المحقق
محمد يحيى الكاندهلوي الحنفي ما نصه (ص ١٥٣):
«وأما اتخاذ المساجد عليها، فلما فيه من التشبه باليهود

(ص ٨١) عن الحافظ ابن حجر أنه قال في «شرح الفتح» لحديث ذي الخلصة
من «صحيح البخاري» في الكلام على الغزوات ما نصه:
«وفي الحديث النهي عن الصلاة في المساجد التي فيها قبور يفتتن الناس بها،
وأنه يجب إزالتها».
قلت: ولم أره في المكان المذكور من «الفتح» فيحتمل أن يكون في موضع آخر
منه، والله أعلم.
