Book of Revocation (Kitāb al-Rajʿah)
— They unanimously agree that if a free man divorces his free wife after consummation, with one or two pronouncements, he retains the right to take her back until her waiting period is completed.
— They unanimously agree that revocation must be effected in the presence of witnesses (1).
— They unanimously agree that the right to revoke belongs to the husband for as long as the woman is in her waiting period, even if she dislikes it.
— They unanimously agree that a revocation requires neither a new dowry nor any other consideration.
— They unanimously agree as well that if, after the waiting period has ended, the divorcing husband claims, “I had already taken you back,” and she denies it, her word prevails—sworn by an oath—and he has no further claim over her. Abū Ḥanīfa alone dissented; he did not allow oaths with respect to marriage (2) or to revocation.
— They unanimously agree that if, within ten days, a woman says, “I have experienced three menstrual cycles and my waiting period is over,” she is not to be believed and her claim is not accepted—unless she adds, “I miscarried a fetus whose form was already distinct.”
